Offshore vs Locally Licensed Casinos: Key Differences Explained

Offshore casinos operate without a license in the jurisdiction where their customers live. Licensed casinos operate with explicit permission. The difference matters.

The distinction between offshore and locally licensed casinos is regulatory rather than geographic. An "offshore" casino is simply one operating under a license in a jurisdiction other than where its customers are located. An online casino licensed in Malta but serving UK customers is technically offshore from the UK perspective, even though Malta is geographically close.

Historically, online casinos emerged in the 1990s outside the US when Americans wanted to gamble online but no domestic license was available. Operators established themselves in offshore jurisdictions like Antigua, Gibraltar, and later Malta. These jurisdictions created gambling licenses designed to attract operators. The operators were offshore from the American perspective.

The regulatory framework in offshore jurisdictions varies. Antigua's licensing was notoriously loose in the 1990s and 2000s. Malta's licensing became more rigorous. Gibraltar's licensing is EU-aligned and strict. The quality of an offshore license depends on which offshore jurisdiction issued it.

Locally licensed casinos operate under a license from the jurisdiction where their customers are located. A casino licensed in New Jersey operates under the authority of the New Jersey Division of Gaming Enforcement. A casino licensed in Ontario operates under the authority of the Alcohol and Gaming Commission of Ontario. The local regulator supervises the operator directly.

The Key Differences

Offshore licensed casinos:

The player protection differences are significant. If you use a locally licensed casino in New Jersey and there is a dispute, you can file a complaint with the New Jersey Gaming Control Board. They will investigate. They have authority to force the casino to resolve the dispute or face license revocation. If you use an offshore casino and there is a dispute, your options are limited. You can file a chargeback with your credit card company. Beyond that, you have civil litigation, which is expensive and difficult against a foreign entity.

The legality question varies. In the US, the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 made it illegal for payment processors to facilitate illegal gambling. This made offshore casinos legally risky for Americans. However, the law does not explicitly make it illegal for Americans to use offshore casinos. The legal status is ambiguous.

In the UK, offshore casinos are legal for consumers to use if the operator is licensed in an approved jurisdiction. The UK Gambling Commission lists approved operators. Using an approved offshore operator is legal. Using an unapproved operator is not.

The regulatory arbitrage question is important. An operator might be licensed offshore to avoid the higher licensing and operational costs of local jurisdictions. A Malta license costs tens of thousands of euros. A New Jersey license costs substantially more. The offshore license allows the operator to serve markets at lower cost. But the lower cost comes with lower regulatory oversight and lower player protection.

The consolidation in the industry has moved toward local licensing. Large operators like DraftKings, FanDuel, and BetMGM obtained local licenses across multiple states and provinces. Smaller operators still operate offshore. As more jurisdictions legalize gambling, the advantage of offshore licensing diminishes.
